De Chinese Wouden, woensdag 20 maart: Hong Kong Artikel 23
De Basiswet die de autonomie en het zelfbestuur van Hong Kong moest garanderen vanaf de overname door China in 1997, bevatte een gevoelig punt. Artikel 23 voorziet in het aannemen van wetten voor de staatsveiligheid. Een poging in 2003 strandde vanwege massale protesten. Sindsdien durfde geen Hongkongs bestuur het meer aan – de recentere protesten betroffen onderwijs, het kiesrecht en uitlevering aan China.
Maar Hong Kong is Hong Kong niet meer sinds 2020. Eind januari dit jaar begon een razendsnelle ‘consultation’, er volgende enorme druk via bijeenkomsten met Chinese functionarissen en nu is gisteren de ‘Safeguarding National Security Ordinance’ ineens aangenomen.
In de South China Morning Post stond een achtergrondstuk waarin bronnen spraken over de enorme haast waarmee men het wetsvoorstel erdoor drukte – om vijandige buitenlandse krachten niet de tijd te geven te mobiliseren. In dat artikel zei men nog dat de tweede van de drie benodigde behandelingen in het wetgevend assemblee gepland stond voor vandaag. Toen werd het dinsdag en ineens werden zowel de tweede als derde lezing er doorheen gejast en was de wet aangenomen. Hij treed op zaterdag 23 maart in werking.
De door Peking eerder al opgelegde staatsveiligheidswet en de praktische veranderingen op de grond in Hong Kong betekenen dat deze nieuwe wet geen grote dingen gaat veranderen. Natuurlijk is er een praktisch effect dat volgt uit het regulariseren van verdere overheidscontrole over de rechtsgang en het verzwaren van straffen. Maar belangrijkste is de verdere verkilling die zal volgen op het signaal. Dat signaal is niet alleen de aanname van de wet, maar ook hóe hij is aangenomen. Het is niet voor niets dat een dissidente Chinese meme een foto van stemuitslagen van het Nationaal Volkscongres naast die van de Legislative Council zette. Al die gegarandeerde Britse politieke en juridische structuren: slechts een show.
